1. Responsable
Carlo Iván Cabrera Arvizu, que opera bajo el nombre comercial bintell, con domicilio en Paraíso 145, San Pedro Residencial, C.P. 21254, Mexicali, Baja California, México, es responsable del tratamiento de los datos personales descritos en este aviso, conforme a la Ley Federal de Protección de Datos Personales en Posesión de los Particulares vigente desde el 21 de marzo de 2025 (la "Ley"). 2. Dos papeles distintos: responsable y encargado
- Como responsable, bintell trata los datos de sus clientes, de las personas de contacto de sus clientes y de sus prospectos. Este aviso cubre esos datos.
- Como encargado, bintell trata los datos de los Llamantes únicamente por cuenta y bajo las instrucciones de cada Cliente. En ese caso, el responsable es el Cliente, y es su aviso de privacidad el que aplica al Llamante. Si usted llamó a un negocio atendido por un agente de bintell, dirija sus solicitudes a ese negocio. Las obligaciones de bintell como encargado están en el Anexo A de los Términos.
3. Datos que recabamos
- Identificación y contacto: nombre, cargo, empresa, teléfono, correo electrónico, domicilio.
- Fiscales: RFC, razón social, régimen fiscal, código postal fiscal, uso de CFDI y constancia de situación fiscal.
- Patrimoniales y de pago: datos necesarios para procesar pagos, comprobantes y registros de facturación. Los datos completos de tarjetas los procesa directamente el procesador de pagos, no bintell.
- Técnicos y de cuenta: credenciales e identificadores de plataformas que el Cliente conecta, dirección IP, fecha y hora de aceptación de los Términos, registros de uso.
- Comunicaciones: grabaciones y notas de juntas de kickoff y soporte, correos y mensajes con bintell.
bintell no solicita a sus clientes datos personales sensibles.
4. Finalidades
Primarias (necesarias para el servicio): identificarle y contactarle; celebrar y cumplir el contrato; implementar, operar, dar soporte y mejorar los Servicios contratados; emitir facturas y cumplir obligaciones fiscales y legales; cobrar adeudos; y defender los derechos de bintell en cualquier procedimiento.
Secundarias (requieren su consentimiento y puede negarse): enviarle promociones, novedades y contenido comercial; invitarle a encuestas; y usar su nombre y logotipo como referencia comercial. Puede negarse en cualquier momento escribiendo a carlo@bintell.ai con el asunto "No uso secundario". Negarse no afecta el servicio contratado.
5. Remisiones y transferencias
Para prestar los Servicios, bintell comparte datos con encargados que los tratan por su cuenta, como proveedores de telefonía y voz (por ejemplo, Retell AI, Twilio, CloudTalk), de calendario (Cal.com, Google), de modelos de inteligencia artificial, de hospedaje, correo, pagos y facturación electrónica. Varios de ellos almacenan datos fuera de México, principalmente en Estados Unidos. Estas comunicaciones no requieren su consentimiento conforme a la Ley.
bintell solo transferirá datos a terceros sin su consentimiento en los casos previstos por la Ley, como requerimientos de autoridad competente, el cumplimiento de obligaciones fiscales o el ejercicio o defensa de derechos en un proceso judicial.
6. Derechos ARCO y revocación del consentimiento
Usted puede acceder a sus datos, rectificarlos, cancelarlos u oponerse a su tratamiento, así como revocar su consentimiento o limitar su uso. Envíe su solicitud a carlo@bintell.ai con: nombre y medio para recibir respuesta; copia de una identificación oficial (o documento que acredite la representación); descripción clara de los datos y del derecho que desea ejercer; y cualquier documento que facilite localizar sus datos. bintell responderá dentro de los plazos que establece la Ley. La revocación no tendrá efectos retroactivos ni sobre datos que deban conservarse por obligación legal o fiscal.
7. Conservación y seguridad
bintell conserva los datos mientras dure la relación y después solo por el plazo necesario para cumplir obligaciones legales y fiscales (por regla general, 5 años para documentación fiscal) o para la defensa de sus derechos. Aplica medidas de seguridad administrativas, técnicas y físicas razonables, como accesos restringidos y autenticación en sus cuentas. Ningún sistema es infalible, y bintell no responde por incidentes ocurridos en la infraestructura de terceros, sin perjuicio de notificarle cualquier vulneración que le afecte de forma significativa.
8. Cookies y tecnologías de rastreo
El sitio web de bintell puede usar cookies y herramientas de analítica para medir visitas y mejorar la experiencia. Puede desactivarlas desde la configuración de su navegador.
9. Cambios a este aviso
bintell publicará cualquier cambio en https://bintell.ai/privacy e indicará la fecha de actualización. Si el cambio requiere un nuevo consentimiento, se lo solicitará.
10. Autoridad
Si considera que sus derechos fueron vulnerados, puede acudir a la Secretaría Anticorrupción y Buen Gobierno, autoridad en materia de protección de datos personales en posesión de particulares.

1. Data controller
Carlo Iván Cabrera Arvizu, operating under the trade name bintell, with address at Paraíso 145, San Pedro Residencial, ZIP 21254, Mexicali, Baja California, Mexico, is the controller of the personal data described in this notice, under Mexico's Federal Law on the Protection of Personal Data Held by Private Parties in force since March 21, 2025 (the "Law"). 2. Two different roles: controller and processor
- As controller, bintell processes the data of its clients, its clients' contact persons and its prospects. This notice covers that data.
- As processor, bintell processes Callers' data solely on behalf of and under the instructions of each Client. In that case, the Client is the controller, and the Client's privacy notice is the one that applies to the Caller. If you called a business served by a bintell agent, direct your requests to that business. bintell's obligations as processor are set out in Annex A of the Terms.
3. Data we collect
- Identification and contact: name, job title, company, phone number, email, address.
- Tax: tax ID (RFC), legal name, tax regime, tax ZIP code, CFDI use and tax status certificate.
- Financial and payment: data needed to process payments, receipts and billing records. Full card data is processed directly by the payment processor, not by bintell.
- Technical and account: credentials and identifiers for platforms the Client connects, IP address, date and time of acceptance of the Terms, usage logs.
- Communications: recordings and notes from kickoff and support meetings, emails and messages with bintell.
bintell does not request sensitive personal data from its clients.
4. Purposes
Primary (necessary for the service): identifying and contacting you; entering into and performing the contract; implementing, operating, supporting and improving the contracted Services; issuing invoices and complying with tax and legal obligations; collecting amounts owed; and defending bintell's rights in any proceeding.
Secondary (require your consent, which you may refuse): sending you promotions, news and commercial content; inviting you to surveys; and using your name and logo as a commercial reference. You may opt out at any time by writing to carlo@bintell.ai with the subject "No secondary use." Opting out does not affect the contracted service.
5. Disclosures and transfers
To provide the Services, bintell shares data with processors that handle it on its behalf, such as telephony and voice providers (for example, Retell AI, Twilio, CloudTalk), calendar providers (Cal.com, Google), artificial intelligence model providers, and hosting, email, payment and electronic invoicing providers. Several of them store data outside Mexico, mainly in the United States. Under the Law, these disclosures do not require your consent.
bintell will only transfer data to third parties without your consent in the cases provided by the Law, such as requests from a competent authority, compliance with tax obligations, or the exercise or defense of rights in legal proceedings.
6. ARCO rights and withdrawal of consent
You may access, rectify or cancel your data or object to its processing (ARCO rights), and you may withdraw your consent or limit its use. Send your request to carlo@bintell.ai with: your name and a way to receive the response; a copy of an official ID (or a document proving representation); a clear description of the data and the right you wish to exercise; and any document that helps locate your data. bintell will respond within the timeframes set by the Law. Withdrawal has no retroactive effect and does not apply to data that must be kept by legal or tax obligation.
7. Retention and security
bintell keeps data for the duration of the relationship and afterwards only for the period needed to meet legal and tax obligations (generally, 5 years for tax records) or to defend its rights. It applies reasonable administrative, technical and physical security measures, such as restricted access and authentication on its accounts. No system is infallible, and bintell is not responsible for incidents occurring on third-party infrastructure, without prejudice to notifying you of any breach that significantly affects you.
8. Cookies and tracking technologies
bintell's website may use cookies and analytics tools to measure visits and improve the experience. You can disable them in your browser settings.
9. Changes to this notice
bintell will publish any changes at https://bintell.ai/privacy and will indicate the date of the update. If a change requires new consent, bintell will request it.
10. Authority
If you believe your rights have been violated, you may contact Mexico's Secretariat of Anti-Corruption and Good Governance (Secretaría Anticorrupción y Buen Gobierno), the authority for personal data held by private parties.
